Summary
- Today’s שיעור on מסכת בכורות דף יא עמוד א explains how different levels of קדושה affect a בעל מום that is nevertheless made הקדש, and it distinguishes between קדושת הגוף and קדושת דמים, including a case where an unfit animal is dedicated so its proceeds buy a קרבן. The משנה sets two contrasting frameworks: when a מום קבוע precedes הקדש the קדושה is low and after פדיון the animal becomes fully חולין with regular חיובים, while when הקדש precedes the מום or the מום is a מום עובר the קדושה is stronger and significant restrictions remain even after פדיון. The גמרא analyzes why בכורה, מתנות, גיזה ועבודה, ולדות וחלב, שחוטי חוץ, תמורה, and פדיון of a dead animal differ across these cases, brings proof-text methods for prohibiting offering a בעל מום even on a במת יחיד, and ties the sugya to debates about העמדה והערכה and even to later אחרונים’ applications such as סחורה בדבר אסור and the logic of תוספת שבת.
- Today's שיעור states that the תורה forbids bringing a קרבן that is a בעל מום and that there are two classic types of קדושה: קדושת הגוף (קדושת מזבח) when an animal is dedicated to be offered, and קדושת דמים, typically for בדק הבית. The שיעור introduces a new application of קדושת דמים where a בעל מום is dedicated not for בדק הבית but so its proceeds fund a קרבן, creating a low-level קדושה that still takes effect despite the act being אסור.
- The משנה rules that for כל הקדשים שקדם מום קבוע להקדשן, although it is אסור to be מקדיש such an animal, a low level of קדושה rests on it, and once it is נפדה it becomes like a regular animal. The redeemed animal is חייבין בבכורה ובמתנות and יוצאו לחולין so that after פדיון it is permitted להגזז ולעבד and its ולדן וחלבן are מותר לאחר פדיונן. The משנה adds that one who slaughters it בחוץ is פטור from שחוטי חוץ because it never had a status that could place it on the מזבח, and it says ואין עושים תמורה because this low קדושה does not generate the דין that “והיה הוא ותמורתו יהיה קדש.” The משנה states ומתו יפדו, and רש״י explains this also teaches that no requirement of העמדה והערכה applies here and that redemption is allowed even though the carcass will be fed לכלבים, unlike the general rule דאין פודים קדשים להאכילם לכלבים.
- The שיעור applies the משנה’s case of redeeming a dead animal for dog-feed to the question of סחורה בדבר אסור and the rule that one should not be in the business of selling נבלות, with a מחלוקת whether the איסור is דאורייתא or דרבנן. The ש"ך and the ב"ח allow selling a טריפה/נבלה that “נזדמנו לו” only to a non-Jew and forbid selling to a Jew who will sell onward, while the ט"ז allows selling to another Jew who will sell it further. The שיעור reports two approaches to defend the ש"ך and ב"ח against a ראיה from the משנה: one answer distinguishes selling to a Jew for feeding a dog from selling for onward commerce, and another answer from שאלות ותשובות ארץ צבי (the קוז'יגלובער) says הקדש represents כלל ישראל so the transaction is not treated as one Jew selling to another Jew in the ordinary sense.
- The משנה teaches חוץ מבכור ומעשר, meaning a בכור that was already a בעל מום in utero still has דין בכור and must be given to the כהן as a בכור בעל מום, and a tenth animal that is a בעל מום still becomes מעשר בהמה. The ראשית ביכורים explains בכור by saying a fetus in the womb is not called a בעל מום until it fully emerges, so קדושת בכור takes hold first, while משנת ר' אהרן (רב אהרן קוטלר) explains both cases by defining the disqualification as limited to human-imposed הקדש on an already-blemished animal, whereas בכור is קדוש מרחם and מעשר is קדוש by the counting emergence as the tenth, not by a standard act of “making it holy” like other הקדשות.
- The משנה continues that כל שקדם הקדשן את מומן or where there is מום עובר at dedication, and afterward a מום קבוע develops and the animal is redeemed, then it remains פטורים מן הבכורה ומן המתנות. The redeemed animal does not fully become חולין for use, since it is still אסור בגיזה ועבודה, and its ולד and חלב remain אסור after פדיון, and השוחטן בחוץ is חייב for שחוטי חוץ; it also עושה תמורה because it possessed full קדושת הגוף. The משנה says if these animals die they יקברו, and the מפרשים explain burial is used rather than burning because the תורה restricts burning to specified cases and because burning might lead to benefit from ashes despite the איסור הנאה, so some ראשונים advise burying deep to prevent any benefit.
- The שיעור records a מחלוקת ראשונים on מום עובר, with one approach treating it as a curable defect and debating whether “curable” includes healing that requires external intervention. Rav Chaim Ozer asks why an animal with מום עובר can be treated as full הקדש when it cannot currently go on the מזבח, and he concludes the core problem of a בעל מום is not merely present unfitness for the מזבח but the fact that a permanent מום makes it redeemable, and redeemability blocks high קדושה. Rav Chaim Ozer says a מום עובר is not subject to redemption because it will pass, so it can retain קדושת הגוף even while temporarily unfit.
- The גמרא infers from “טעמא דנפדו” that before פדיון the low קדושה of the first case still exempts from בכורה and מתנות and still forbids גיזה ועבודה. The גמרא suggests this supports רבי אלעזר that קדשי בדק הבית are אסורים בגיזה ועבודה, and the ראשונים explain the need for a distinct איסור beyond מעילה through cases like buying wool from הקדש or taking less than שוה פרוטה where מעילה does not apply. The גמרא rejects the proof by distinguishing קדושת דמים למזבח, which is easily confused with קדושת הגוף למזבח so חז"ל decreed a restriction before פדיון, from קדשי בדק הבית which are dissimilar and would not necessarily share that gezeirah.
- The גמרא asks how the משנה’s היתר of ולדן וחלבן works and rejects the trivial case where conception and birth occur only after פדיון. The case becomes where the animal conceives before פדיון but gives birth after פדיון, implying that if it gave birth before פדיון the offspring would be אסור without redemption, with רש״י indicating the offspring requires פדיון and is not itself offered, while the חזון איש questions whether רש״י might allow offering if one wishes. The sugya asks whether such offspring can be redeemed while תמימים, and a ברייתא rules that the offspring of a permanently blemished animal dedicated for the מזבח are sold and do not need a מום because “שאין קדושה חלה עליהם” and because שלאו טפל חמור מן העיקר.
- The שיעור cites אחרונים who use the principle שלאו טפל חמור מן העיקר to resolve whether a boy who becomes בר מצווה on מוצאי יום כיפור or מוצאי שבת is obligated in תוספת. The analysis says תוספת יום הכיפורים is not possible when he was not obligated in the fast itself, and it uses the sugya’s rule to argue תוספת שבת cannot be more stringent than שבת itself, so one not obligated in שבת דאורייתא cannot be obligated in its תוספת דאורייתא.
- The גמרא contrasts the low קדושה case by stating that if one is מקדיש זכר לדמים, then despite the language of value, קדושת הגוף can take hold, and this supports רבא’s rule that since it is fit for קדושת הגוף that קדושה becomes חל and “spreads” beyond mere בדק הבית. The Rosh explains the case as one who says סתם “it should be קודש” without specifying, and despite a general rule that such an expression defaults to בדק הבית, here it becomes קדושת הגוף. רש״י explains רבא used זכר because most offerings are עולות which are male and says a healthy נקבה would become a שלמים, while תוספות says the דין applies only to זכר and not to נקבה, and other ראשונים say a נקבה would be sold to fund an עולה because the standard goal is עולה rather than שלמים.
- The משנה’s version says השוחט בחוץ is פטור, but רבי אלעזר has a version reading חייב because the animal is “מוקל בבמות יחיד.” רבי אלעזר derives that offering a בעל מום on a במת יחיד during the time of היתר הבמות violates a לא תעשה from לא תזבח לה׳ אלקיך שור ושה אשר יהיה בו מום כל דבר רע, using אם אינו עניין to transfer the verse from במה גדולה—already covered by עורת או שבור או חרוץ או יבלת או גרב או ילפת—to במת יחיד. The שיעור notes a rationale why אם אינו עניין is not listed among the thirteen מידות in ברייתא דרבי ישמעאל, because it is treated as if explicit in the תורה rather than merely a דרש.
- The גמרא suggests the verse might instead teach that a בכור בעל מום or מעשר בעל מום may not be offered on a במה גדולה, since their קדושה takes effect even when blemished, but it answers that בכור is explicit from וכי יהיה בו מום פסח או עור כל מום רע לא תזבחנה לה' אלקיך and that מעשר is learned by גזירה שוה העברה העברה מבכור. The גמרא suggests the verse might teach about a תמורה that is a בעל מום, but it answers from the comparison והיה הוא ותמורתו that the תמורה follows the original’s דין and cannot be offered with a מום. The g’mara then considers ולדות קדשים and answers via a teaching of תנא דבי רבי ישמעאל from רק קדשיך אשר יהיו לך ונדריך תשא ובאת אל המקום אשר יבחר ה', where רק קדשיך includes תמורות and אשר יהיו לך includes הולדות, and they are compared to נדר so that just as a נדר בעל מום cannot be offered, so too תמורה and ולדות cannot be offered when בעלי מומים, leaving the verse’s role to establish the prohibition of בעל מום even on a במת יחיד.
- The גמרא asks why the first case in the משנה cannot make תמורה and derives it from לא יחליפנו ולא ימיר אותו טוב ברע או רע בטוב. The g’mara explains that the phrasing teaches that only an animal that was “טוב מעיקרא” can generate תמורה, while if it was “רע מעיקרא,” meaning a בעל מום at the time of הקדש, it אינו עושה תמורה.
- The שיעור summarizes that מסכת תמורה defines the requirement of העמדה והערכה and records differing ראשונים about whether the animal must stand before the כהן, be capable of standing, or merely be brought before him. It reports that רבי שמעון limits העמדה והערכה to קדשי מזבח and only when the animal was not a בעל מום at הקדש, and it presents a מחלוקת רבי יוחנן וריש לקיש about the חכמים: רבי יוחנן holds קדשי בדק הבית always require it and קדשי מזבח depend on whether the מום preceded הקדש, while ריש לקיש holds only בדק הבית requires it and קדשי מזבח do not. The גמרא identifies our משנה as רבי שמעון’s view and says he is מודה that a בעל מום מעיקרא is excluded from העמדה והערכה based on the word אותה, while attributing the stricter burial rule of “חכמים אומרים אם מתו יקברו” to תנא דבי לוי who includes all consecrated living creatures, even חיה and עוף and even בעל מום מעיקרא, within העמדה והערכה, leaving “אותה” difficult for his position.
- תוספות objects to the phrase “מודה רבי שמעון” because the sugya implies that all opinions ultimately agree a בעל מום מעיקרא lacks העמדה והערכה, making “admission” seem unnecessary. The יפה מראה answers by distinguishing two meanings of מודים: admission and submission versus thanksgiving and praise, using the halacha of bowing only at מודים in שמונה עשרה but not at ולך לבדך אנחנו מודים, where bowing is הרי זה מגונה. The יפה מראה applies this to “כולי עלמא מודה” and “רבי שמעון מודה” as language of shared affirmation and שבח rather than a concession in a dispute.
